Insurance adviser licensure opposed

Gov. Terry Branstad, should veto a budget bill a requirement mandating that the advisers to help Iowans compare health insurance options are licensed, an advocacy group said in a letter to the governor on Tuesday.
The Legislature this month passed a bill that includes language setting the qualifications for the so-called "navigators" who act as advisers on public enforcement of federal health care reform act that opponents are often called ObamaCare.
AARP said in its letter that it is not against training navigators, but it concerns that licensure would create a barrier to helping Iowans - especially low-income families or rural areas - get far to afford health care.
The group, with 380,000 members Iowa, also said the way in which the provision was attached to a larger bill and avoid the usual legislative process runs counter to Branstad's commitment to transparent government.
The requirements include licensure House File 2465, which opponents said was a backdoor way to give an unfair advantage to the insurance agent or broker. In addition they contend the provision is contrary to federal policy.
The bill's supporters, however, say licensure helps to protect the public by ensuring advisers have knowledge.
The idea is for the position to help guide the public through the choice of insurance. The federal government has policies in place that say the state can not require the position of the agent or broker of insurance and can not be paid a percentage commission.
Tom Alger, a spokesman for the Iowa Insurance Commissioner Susan Voss, agreed earlier this month that the provision is potentially problem.
The commissioner asked federal officials to rule on the matter earlier this year when it was discussed.
It is not known exactly what action the federal government may take if the state rule is indeed considered illegal, Alger said.
Branstad has 30 days to examine the charges that have passed prior to May this year nine legislative delay. He has not said a public position on the matter, and his mouth, Tim Albrecht, the governor declined to outline the object
