Court hears wife killed for insurance money

There is strong evidence suggesting Gerard Baden-Clay has murdered his wife so he could claim his life and settle down with his mistress, a Brisbane court was told.2 months free pass digital
The real estate agent of 41 years is charged with the murder of his wife, Allison 43, whose body was found on a creek bank 10 days after being reported missing on April 20.
Explosive new details of the case to the police emerged during unsuccessful Mr Baden-Clay bail before the Supreme Court in Brisbane yesterday.
Crown prosecutor Danny Boyle said while the evidence against Mr. Baden-Clay was largely circumstantial, the combination of circumstances surrounding the case was convincing.
His marriage was in trouble and he had signaled his intention to leave his wife for his mistress, and even set a deadline of 1 July, Mr. Boyle said.
Mr. Baden-Clay was in dire financial straits and stood to gain much of an insurance benefit, if his wife died.
Mr. Boyle said Allison blood was found in the car of Mr. Baden-Clay, and "the amount and position of the blood" suggested that the seat had been "laid flat to make a start."
Forensic tests showed a scratch on the face of Mr. Baden-Clay was not compatible with a shaving injury, which he had claimed. Mr. Baden-Clay had done research on the web keyword "selfincrimination" shortly before he reported to police that his wife had disappeared.
And he and the couple's three children were alone in the house with Allison on the night of his death.
Mr. Baden-Clay has also taken substantial information on his wife's life insurance policy after his body was found, but before he was formally identified, the court heard.
Defence counsel Peter Davis SC said the case against Mr. Baden-Clay was entirely circumstantial.
A post-mortem of the body showed no external injuries except a chipped tooth, Mr. Davis said.
"There is no evidence of the cause of death, there is no real evidence of the location of death, and there is no evidence that my client is on the bridge (near where the Allison's body was found), "he told the court.
There was also no evidence of a weapon and no evidence that Mr. Baden-Clay had left home the night of the disappearance of his wife.
Justice David said brace he did not accept that the business of the Crown was weak. He said there were strong reasons for Mr. Baden-Clay to flee if he was given bail, community ties notwithstanding.
"Flight is a real risk," said the judge.
